On August 24, Ethereum-based game L3 Xai initiated litigation against Elon Musk’s AI startup xAI, alleging trademark infringement and unfair competition in the Northern District of California.
The filing by Delaware entity Ex Populus states it has deployed the XAI mark in US commerce since June 2023, notably within its blockchain gaming ecosystem and via the XAI token, and contends that the defendant’s actions have damaged the brand.
Plaintiffs frame the matter as a conventional trademark dispute that “requires court intervention for remedy,” asking the court to address the alleged infringement and resulting unfair competition affecting commercial use of the mark.
