Tornado Cash Case: Jay Clayton Strongly Opposes Roman Storm's Motion
New York Southern District Prosecutor Jay Clayton, as former SEC Chairman, responded on Tuesday in the US New York Southern District Federal Court to Tornado Cash co-founder Roman Storm’s acquittal motion. Clayton described Storm’s use of Tornado Cash for criminal purposes as “at best window dressing, at worst a complete deception” and rejected Storm’s request to use the civil copyright case Cox Communications v. Sony Music Entertainment for his defense. Clayton stated that Storm’s behavior was not like in the Cox case and that he did not take effective money laundering precautions. This response is critically important at a time when privacy-focused protocols are under regulatory pressure.

Latest in the Storm Case and Retrial
Last August, the jury convicted Storm of operating an unlicensed money transmission business but deadlocked on money laundering and sanctions violation conspiracy charges, opening the door to a retrial. Prosecutors and defense will meet on Thursday. Meanwhile, US President Donald Trump appointed Todd Blanche, who called for ending “regulation by enforcement” at the Department of Justice, as acting Attorney General. Storm used Blanche’s memo in his favor, but no retrial date has been set yet. The decision could impact the future of DeFi privacy tools.
